PRICING AND PAYMENT METHODS

All prices are subject to change without notification, and while every effort is made to ensure the accuracy of the prices displayed on ArialKhan Limited, they are not guaranteed to be accurate. If any price is different from that displayed we will inform you before dispatching the order and you will have the option of continuing with the order or not.

We are determined to provide the most accurate pricing information on the Site to our users; however, errors may still occur, such as cases when the price of an item is not displayed correctly on the Site. As such, we reserve the right to refuse or cancel any order. In the event that an item is mispriced, we may, at our own discretion, either contact you for instructions or cancel your order and notify you of such cancellation. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your pre-payment processed. If such a cancellation occurs on your prepaid order, our policies for refund will apply.

Payment Method Condition

Cash on Delivery: For orders of any amount including delivery charge is applicable for cash on delivery.
Online Payment: Applicable for any ordered amount as per company policy.

Note: For orders more than BDT 500 amount, customers may need to make an advance payment of 10% of the total value (minimum). For higher valued items like Computers, refrigerators, Freezers, AC, Smartphones, Washing Machines, Gold and Diamond ornaments etc. customers need to pay the delivery charge in advance to confirm the orders. The delivery charge may vary depending on the weight of the product, delivery medium (third party logistics, transport, etc.) and delivery location. Inside Dhaka City and Outside Dhaka City order confirmation advance may vary, and customers will be informed in custom cases and decisions. 

ERRORS

Occasionally there may be visible information on our website or some Services containing typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information, on our or on any related website, is inaccurate at any time without prior knowledge.

Following the updates in eCommerce policies and laws in any respective time, we may change and update our terms and conditions anytime without prior notice.

1.0 – YOUR ACCOUNT

1.5 – RESELLING OUR PRODUCTS

Reselling ArialKhan Limited’s own imported products for business purposes is strictly prohibited without our prior concern. If any unauthorized personnel is found committing the above act, legal action may be taken against him/her. If we have a special category for your business that will be open for all and there will be no issues regarding business (Ex: SME, B2B etc.), considering both parties agree and properly understand the facts related hereafter.

1.6 – CLAIMS AGAINST INFRINGING CONTENT

We respect the intellectual property of others. If you believe that your intellectual property rights have been used in a way that gives rise to concerns of infringement, please write to us at (suggested mail – arialkhan2041@gmail.com) and we will make all reasonable efforts to address your concern within a reasonable amount of time. Please ensure to provide your name, address, contact information and as many relevant details of the claim including name of infringing party, instances of infringement, proof of infringement amongst others. Please note that providing incomplete details will render your claim invalid and unusable for legal purposes. In addition, providing false or misleading information may be considered a legal offense and may be followed by legal proceedings.

1.7 – FRAUD ALERT

We will take legal action if we receive evidence of fraud and illegal and any type of money transaction between customer and seller. This is strictly prohibited. And, if any customer is found placing orders without any intention to take delivery (usually via COD), the customer may get a permanent ban from ArialKhan Limited and in extreme cases may legal steps be taken from the company. The same instruction is applicable for the people who buy and alter the delivered items with another faulty/different item in absence of any witness and after sometime claims refund or return with invalid claims.

1.8 – TERMINATION

In addition to any other legal or equitable remedies, we may, without prior notice to you, immediately terminate the Terms and Conditions or revoke any or all of your rights granted under the Terms and Conditions. Upon any termination of this Agreement, you shall immediately cease all access to and use of the Site and we shall, in addition to any other legal or equitable remedies, immediately revoke all passwords and account identification issued to you and deny your access to and use of this Site in whole or in part. Any termination of this agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination. You furthermore agree that the Site shall not be liable to you or to any other person as a result of any such suspension or termination. If you are dissatisfied with the Site or with any terms, conditions, rules, policies, guidelines, or practices in operating the Site, your sole and exclusive remedy is to discontinue using the Site.

Stock availability:

ArialKhan Limited reserves the right to refuse to honor an order. This means that if an item unexpectedly goes out of stock after an order is placed the company can decide to stop selling an item. All products are subject to availability and we reserve the right to impose quantity limits on any order, to reject all or part of an order, and to discontinue products without notice, even if you have already placed your order. 

Your placement of an order as a customer does not necessarily assure that we will accept your order. We reserve the right to refuse any order at our sole discretion. In addition, before accepting your order, we may require additional information if you have not provided all the information required by us to complete your order.

পণ্যসমূহের মূল্য কোনো রকম তথ্যপ্রদর্শন ছাড়াই পরিবর্তনসাপেক্ষে; আড়িয়ালখাঁ লিমিটেডে প্রদর্শিত মূল্যের নির্ভূলতা নিশ্চিত করার জন্য সর্বাত্মক প্রচেষ্টা থাকলেও সেগুলো সর্বদাই সঠিক হবে এমন নিশ্চয়তা দেয়া হচ্ছে না। যদি কোনো পণ্যের মূল্য প্রদর্শন করা মূল্য থেকে ভিন্ন হয় তবে আমরা অর্ডারটি প্রেরণের আগে আপনাকে অবহিত করবো এবং আপনার কাছে অর্ডারটি পাঠানো বা বাতিল করার সিদ্ধান্ত গ্রহণের অপশন আপনার কাছেই থাকবে।

কোনো অর্ডার কনফার্মড বা পেন্ডিং কিংবা প্রিপেইড যে অবস্থাতেই থাকুক না কেনো, আমরা সেটি বাতিল বা ক্যান্সেল করার অধিকার সংরক্ষণ করছি। আপনার প্রিপেইড অর্ডার এই প্রক্রিয়ায় বাতিল হলে আমাদের অর্থ ফেরত প্রদাণের নীতিমালা প্রযোজ্য হবে।

অনলাইন পেমেন্টঃ কোম্পানি পলিসি অনুযায়ি যে কোনো অর্ডারের ক্ষেত্রে গ্রহণযোগ্য।

নোটঃ ৫০০ টাকার উপরের এমাউন্টের অর্ডারের ক্ষেত্রে গ্রাহককে মোট মূল্যের ১০% (ন্যুণতম) অগ্রিম প্রদান করতে হতে পারে। অধিক মূল্যের পণ্য যেমন কম্পিটার, রেফ্রিজারেটর, ফ্রিজার, এসি, ওয়াশিং মেশিন, গোল্ড এবং ডায়মন্ডের অলংকার, ইত্যাদি পণ্যের জন্য ক্রেতাকে অর্ডার কনফার্ম করতে ডেলিভারি চার্জ অগ্রিম প্রদান করতে হবে। ডেলিভারি চার্জ মূলত পণ্যের ওজন, ডেলিভারি করার মাধ্যম (তৃতীয় পক্ষ, পরিবহন, ইত্যাদি) এবং ডেলিভারি লোকেশনের উপর নির্ভর করে। ঢাকা সিটির ভেতরে এবং ঢাকা সিটির বাইরের অর্ডার কনফার্মেশনের ক্ষেত্রে এডভান্স ভিন্ন ভিন্ন হতে পারে, এবং গ্রাহককে এধরণের কেইস বা সিদ্ধান্তের ব্যাপারে জানানো হবে।

সেকশন ৩ – ভুলসমূহ

আরিয়ালখাঁ অনলাইন শপের আমদানিকৃত পণ্য পূর্বানুমতি ছাড়া ব্যবসায়িক স্বার্থে রিসেলিং বা পূনঃবিক্রয় করা কঠোরভাবে নিষিদ্ধ। যদি কোনো অননুমোদিত ব্যক্তিকে এমন কাজ করতে দেখা যায়, তাহলে তার বিরুদ্ধে আইনানুগ ব্যবস্থা গ্রহণ করা হতে পারে। আমাদের যদি আপনার ব্যবসার জন্য কোনো বিশেষ ক্যাটাগরি থাকে যা সকলের জন্য উন্মুক্ত তাহলে উভয়পক্ষের নানাবিধ সম্পর্কিত ব্যাপারে সম্মতি এবং সমঝোতার মাধ্যমে হলে ব্যবসা সংক্রান্ত কোনো বাঁধা থাকবে না (যেমন: SME, B2B ইত্যাদি)।

১.৬ – বিষয়বস্তু লঙ্ঘনকারীর বিপক্ষে দাবি

আমরা অন্যের মেধাসম্পদের সম্মান দিয়ে থাকি। আপনি যদি বিশ্বাস করেন যে আপনার মেধা সম্পত্তি এমনভাবে ব্যবহার করা হয়েছে যা অধিকার লঙ্ঘনের ইস্যু সৃষ্টি করে, অনুগ্রহ করে আমাদের জানান (ইমেইলঃ arialkhan2041@gmail.com) এবং আমরা যুক্তিসঙ্গত সময়ের মধ্যে আপনার উদ্বেগের সমাধান করার জন্য প্রচেষ্টা বহাল রাখবো। অনুগ্রহ করে আপনার নাম, ঠিকানা, যোগাযোগের তথ্য এবং লঙ্ঘনকারী পক্ষের নাম, লঙ্ঘনের উদাহরণ, অন্যদের মধ্যে লঙ্ঘনের প্রমাণসহ দাবির সাপেক্ষে সম্পর্কিত বিস্তারিত তথ্যাদি সরবরাহ নিশ্চিত করুন৷ অনুগ্রহ করে খেয়াল রাখবেন যে অসম্পূর্ণ বিবরণ প্রদান করলে আপনার দাবি অবৈধ এবং আইনি উদ্দেশ্যে অব্যবহারযোগ্য বলে গণ্য করা হবে। একই সাথে, মিথ্যা বা বিভ্রান্তিকর তথ্য প্রদান একটি আইনি অপরাধ হিসাবে বিবেচিত হতে পারে এবং এক্ষেত্রে প্রয়োজনীয় আইনি প্রক্রিয়া অনুসরণ করা হতে পারে।

১.৭ – জালিয়াতি সংক্রান্ত সতর্কতা

গ্রাহক ও বিক্রেতার মধ্যে প্রতারণা ও অবৈধ এবং যেকোনো ধরনের অর্থ লেনদেনের প্রমাণ পেলে আমরা আইনি ব্যবস্থা নেব। এটি কঠোরভাবে নিষিদ্ধ। এবং, যদি কোনো গ্রাহককে ডেলিভারি নেওয়ার (সাধারণত COD এর মাধ্যমে) কোনো বাস্তবিক ইচ্ছা ছাড়াই অর্ডার দিতে দেখা যায়, তাহলে সেই গ্রাহক আড়িয়ালখাঁ লিমিটেড এর পক্ষ থেকে স্থায়ী নিষেধাজ্ঞা পেতে পারেন এবং চরম ক্ষেত্রে কোম্পানির পক্ষ থেকে প্রয়োজনীয় আইনি পদক্ষেপ নেওয়া হতে পারে। একই নির্দেশনা সেসকল গ্রাহকদের জন্য প্রযোজ্য যারা কোনো সাক্ষীর অনুপস্থিতিতে ক্রয়াদেশ দেয়ার পর ডেলিভারিকৃত আইটেম অন্য ত্রুটিপূর্ণ/ভিন্ন আইটেম দিয়ে পরিবর্তন করে থাকেন এবং পরবর্তীতে অর্থ ফেরতের দাবি করে বা অবৈধ দাবিসহ পণ্য ফেরত দিয়ে থাকেন।

১.৮ – বাতিলকরণ

অন্য কোনো আইনি বা ন্যায়সঙ্গত প্রতিবিধান ছাড়াও, আমরা আপনাকে কোনো রকম পূর্ব-বিজ্ঞপ্তি না দিয়েই শর্তাবলী সমূহ অবিলম্বে বাতিল করতে পারি বা শর্তাবলীর অধীনে অনুমোদিত যেকোনো বা সকল অধিকার প্রত্যাহার করতে পারি। এই চুক্তির যেকোন অংশ অকার্যকর বা বাতিল হলে আপনি অবিলম্বে সাইটের সমস্ত অ্যাক্সেস এবং ব্যবহার বন্ধ করে দেবেন এবং আমরা অন্য কোনো আইনি বা ন্যায়সঙ্গত সমাধান ছাড়াও অবিলম্বে আপনাকে ইস্যু করা সকল পাসওয়ার্ড এবং অ্যাকাউন্ট শনাক্তকরণ এক্সেস প্রত্যাহার করব এবং সাইটে সম্পূর্ণ বা আংশিক প্রবেশাধিকার ও ব্যবহার বন্ধ করবো। চুক্তির যেকোন অংশ অকার্যকর বা বাতিল হলেও চুক্তি বাতিলের তারিখ পর্যন্ত পক্ষসমূহের মধ্যে অধিকার এবং বাধ্যবাধকতার (যেমন কার্যসীমা বা পেমেন্ট বিধিনিষেধ) উপর বিদ্যমান চুক্তি বাতিলকরণের প্রভাব পড়বে না। আপনি আরও সম্মতি দিচ্ছেন যে, এই ধরনের কোনো স্থগিতাদেশ বা সমাপ্তির ফলে সাইটটি আপনার বা অন্য কোনো ব্যক্তির কাছে দায়বদ্ধ থাকবে না। আপনি যদি সাইটটির ব্যাপারে অসন্তুষ্ট থাকেন বা সাইটটি পরিচালনার সাথে সম্পর্কিত বিধি, শর্তাবলী, নিয়মাবলী, নীতিমালা, নির্দেশিকা বা ব্যবহারবিধির ব্যাপারে অসন্তুষ্ট থাকেন, তবে আপনার একক এবং বিশেষ সমাধান হল সাইটটি ব্যবহার বন্ধ করা।

১.৯ – অন্যান্য

স্টক এভেইলেবিলিটিঃ

কোনো অর্ডার বাতিল বা সম্পন্ন করার অধিকার আড়িয়ালখাঁ লিমিটেড সংরক্ষণ করে। এর অর্থ হলো যদি অনাকাঙ্ক্ষিতভাবে কোনো পণ্য অর্ডার পাবার পর তার স্টক শেষ হয়ে যায় কোম্পানি তা বিক্রয় বন্ধ করার সিদ্ধান্ত বাতিল করতে পারে। 

সকল পণ্য পর্যাপ্ততার উপর নির্ভরশীল এবং আমরা যেকোনো পণ্যের অর্ডারে সীমা নির্ধারণের অধিকার সংরক্ষণ করি, যাতে একটি অর্ডার সম্পূর্ণ বা আংশিক প্রত্যাখ্যান করা এবং ইতোমধ্যেই অর্ডার দিয়ে থাকলেও কোনো পূর্বনোটিশ ছাড়াই পণ্যের অর্ডার সরবরাহ বাতিল করার অধিকার সংরক্ষণ করি। একজন গ্রাহক হিসাবে আপনার অর্ডার প্লেসমেন্ট হলেও এমনটি নিশ্চিত হবে না যে আমরা আপনার অর্ডারটি গ্রহণ করব। আমরা আমাদের নিজস্ব বিবেচনার ভিত্তিতে কোনো অর্ডার প্রত্যাখ্যান করার অধিকার সংরক্ষণ করি। উপরন্তু, আপনার অর্ডার সফলভাবে গ্রহণ করার আগে আপনার পক্ষ থেকে অর্ডার সংক্রান্ত সমস্ত তথ্য সরবরাহ না হয়ে থাকলে বাড়তি তথ্যের প্রয়োজন হতে পারে।
